This session is designed to explore and decipher through the interdependency between health care law, labor and employment regulations, and immigration regulations to effectively manage the recruitment and hiring process, H.R. compliance and documentation, and the drafting of employment agreements.
- Understand the interdependency between health care, labor & employment, and immigration regulations, including applicable statutes and rules, applicability to risk management and compliance, and consequences of non-compliance.
- Understand immigration basics: introduction to (i) the non-immigrant visas available to health care providers – including types, availability, cost, timeline, pros and cons, options for spouses and dependents, etc.; and (ii) the green card process – types of permanent visas available to health care providers, availability, timeline, pros and cons, dependent, traveling restrictions, etc.
- Gain a practical understanding of the potential compliance pitfalls during recruitment and hiring process – antidiscrimination laws applicable to foreign nationals, best practices and tools to optimize recruitment , new Form I-9 and documentation, document retention for H-1B visas, J-1 visa waivers, and green card applications, unlawful employment agreement terms, etc.
