This interesting article, Winning Less May Mean More to Your Client in the End, from this morning’s “Corporate Counsel” discusses the benefits for a defendant in a civil action of the following two-pronged litigation approach: (1) filing a targeted partial motion to dismiss a complaint; and then (2) attempting to dispose of the remainder of claims not subject to dismissal on the pleadings in settlement or arbitration.
