The 5th Circuit throws another curveball – Corporate Transparency Act nationwide preliminary injunction reinstated

The 5th Circuit Court of Appeals (the “Court”) has reinstated the nationwide preliminary injunction – once again preventing enforcement of the Corporate Transparency Act (“CTA”) pending appeal. Only three days after the government’s emergency motion to stay the injunction was granted, the merits panel of the Court vacated the order “to preserve the constitutional status quo while the merits panel considers the parties’ weighty substantive arguments.” FinCEN has yet to release a response, but we will issue additional updates as warranted.
